Sailing School Terms & Conditions

1. Contract

Your contract is with SailTime Newport. When you sign the booking form and make the deposit payment you are accepting these conditions. The booking agreement becomes binding when signed by you and confirmed in writing or email by SailTime Newport.. This contract will be construed in accordance with Australian Law and it is agreed between us that each will submit to the jurisdiction of the Australian Courts.

2.  Booking Procedure

Bookings must be made in writing on our booking form and accompanied by a deposit of 20% or payment in full. We will accept provisional bookings by telephone or email and will normally hold them for 5 days (but less if made within 2 weeks of the course start date), after which they will expire unless the signed booking form is received in our office.

3. Payment

The booking deposit/ payment must be sent with your booking form to secure your booking. The balance payment is payable no later than 28 days prior to the course start date. If the balance payment remains unpaid within 28 days prior to the course start date we reserve the right to cancel your booking with no refund of deposit. We can accept the following payment methods:

  • Debit or Credit cards by phone: Visa, MasterCard
  • Electronic Finds Transfer payable to ‘SailTime Newport’ BSB 062 000 Account 1343  2394

4. Cancellation

If you have to cancel a confirmed booking for any reason this must be in writing and signed by the person who signed the booking form.( see fax number at foot of page )  The cancellation will be effective from the date it is received by SailTime Newport. Cancelation 28 days or less: You are liable for the full course fee where you cancel with 28 days or less notice. Cancelation more than 28 days If you cancel more than 28 days before the commencement of the course only the  deposit is forfeited in addition you have the option for an additional administration fee of $150 to rebook an alternative course date and have your deposit applied the new booking .

Holiday insurance, including cancellation cover, is strongly recommended.

In the event that SailTime Newport has to cancel the course for whatever reason, SailTime Newports’ liability will be limited to payments already received from you for that course, and there shall be no liability on the part of either party to pay compensation to the other.

5. The Yacht

SailTime Newport reserves the right to change the yacht at any time, prior to or during the course, in the event of technical problems, damage, or any other reason.

6. Clients Obligations

The Client hereby agrees:

  • That the details on the booking form are complete, accurate, and not misleading. The Client shall as required give the skipper every assistance in the handling of the yacht and shall comply promptly with his instructions.
  • Not to pay any expense on behalf of SailTime Newport without prior consent.
  • Not to bring any animals, plants or restricted items, or any illegal goods such as drugs or firearms on board the yacht.
  • All clients must be able to swim 50 metres.
  • All clients must read, understand, and comply with the safety information on the joining instructions.

The yacht is fully insured against accidents and third party liability, but SailTime Newport does not accept responsibility for personal accidents, damage or loss due to your negligence. Unnecessary damage and losses attributed to carelessness of a client will be paid for by the client at replacement price accounting for fair wear and tear. You are strongly recommended to arrange your own insurance cover for cancellation, injury and personal liability.

7. SailTime Newport’s Obligations

SailTime Newport shall provide the yacht in good and seaworthy condition complying with the provisions of the relevant state Maritime Commercial  Vessels Code of Practice.

SailTime Newport shall endeavour to provide the course as booked, however the skipper may change the itinerary, start/finish locations, and course content, if in his opinion, bad weather or any other reason, will risk the safety of the yacht or any person on board, or vitiate the insurance, or risk late re-delivery at the end of the course period. The safety of the yacht and crew shall be a priority.

8. Complaints

We sincerely hope that our customers never have a cause for complaint.  Any complaint will be taken very seriously by SailTime Newport and will be dealt with immediately upon receipt.  An initial response will be given within 48 hours of receipt.  Please send any complaints in writing to ‘The Principal, SailTime Sailing Training’ at the address on the booking form or call our customer feedback line 1300 944 974 or email training@sailtimeaustralia.com.au
